Executive Timbers Resort Involved in Accusations of Misrepresentation
A southwest Missouri timeshare company is receiving numerous complaints from customers seeking restitution and legal action. The consumers claim that Branson Log Homes – or Executive Timbers Resort and Golf Course, as it is known locally – used unethical sales tactics on multiple occasions, including deception, fraud, and misrepresentation. Among the specific accusations being leveled against Branson Log Homes were the following:
• Failure to notify customers of their right to contract cancellation, failure to allow customers the legally-mandated five day cancellation period after purchase.
• Failure to notify customers of maintenance fees on traded properties, subsequent billing and collection of said fees.
• Failure to make reimbursement for maintenance fees after promising to do so.
• Failure to make good on initial sales promises such as an additional membership in a travel club that was said to be included with timeshare plans. Failure to notify consumers that Branson Log Homes is more than $30,000 in debt to the travel club they promised membership in.
Attorney General Jay Nixon has filed a lawsuit on the consumers’ behalf, seeking injunctive relief and civil penalties. “A number of consumers spent thousands of dollars and attempted to trade in their existing timeshares as part of an agreement to purchase a new timeshare from Branson Log Homes,” he says. “Many were promised travel club memberships that were never delivered. Others are still paying out of their own pockets for maintenance on timeshares because the defendant omitted essential information about the timeshare trade process and implied that the consumer would no longer have to pay.”
The lawsuit stipulates that Branson Log Homes cease and desist the various violations of consumer protection laws and pay restitution to all customers who suffered a loss (along with civil penalties and legal fees). It is estimated that Branson Log Homes customers lost, on average, between $7,000 and $17,000 due to the alleged fraud.
